US DISTRICT JUDGE JOHN BATES RULES IN FAVOR OF DACA


[Houston, TX] On Tuesday April 24, 2018 US District Judge John Bates rules Tuesday afternoon that the legal argument that the Trump Administration used to end DACA on September 5th. 2017 is frivolous and has no real legal basis. This makes the third federal judge to rule against the Trump administration in regards to DACA.

Coming as a surprise to many advocates and critics of DACA. John Bates ruling sets an important precedent because of his political affiliation with the Republican Party and also because unlike his two Democratic counterparts, Bates ruling orders the Department of Homeland Security to re-establish DACA fully, meaning new first time applications and possibly advance parole, if they cannot provide a new, factual legal argument withing 90 days of his ruling.

If the Trump administration fails to do so, DHS will have no option than to open the program completely as it was before September 5th, 2018.
